Being caught speeding in urban areas is more expensive than out of town. However, the ADAC warns of special cases in which this cannot be clearly recognized.
Munich – Speeding violations are by far the most common traffic offenses. Almost 1.9 million men were caught in 2022. Over 500,000 women did not stick to the prescribed speed and were caught speeding, as the
ADAC
reports. A total of 8,690 speeders were caught at the last 24-hour speed camera marathon in Bavaria. If a driver exceeds the speed limit, they face fines, points deducted or even driving bans. But there are differences.
The fine increases in urban areas, but what about highways that go through or along the city?
Therefore, a distinction is made between an offense outside of town or within town. This is simply due to the maximum permissible speed, which is generally lower in urban areas than out of urban areas. And: the amount of the fine varies. If you drive 10 km/h too fast outside of town, you pay 20 euros. Within town, 30 euros are due. But what about highways that run through an urban area?
Motorways that run through or along metropolitan areas are usually listed as out of town. But there are differences there too. The speed limits apply there as usual or as displayed on site. But the fine is higher if a motorway is classified as an urban area.
Court rejects complaint: Driver is caught on a highway that is classified as an urban area
The ADAC refers to a case from Berlin. Here a driver was measured at 147 km/h. He drove on the Berlin city highway, where the speed limit is 80. The district court sentenced the speeder to pay 1,000 euros.
There were also two points in Flensburg and a three-month driving ban. The driver lodged a complaint because the court, in his opinion incorrectly, assumed that the offense was classified as an inner-city offense.
But he was unsuccessful. The motorway in the Berlin urban area is classified as an urban area, and the fine is correspondingly higher. In urban areas you can expect higher volumes and traffic jams, numerous entrances and exits and a mostly winding route. Therefore, there is a higher risk, which leads to higher penalties.
