“I was twelve then”: 41-year-old is said to have created hell on earth for his daughter

Her dad is an alcoholic. “He was drunk from midday,” those involved in the trial against the 41-year-old man from the northern district heard in the regional court. “When he came into my room, I was twelve.”

The allegations against the 41-year-old, which are being heard in the Landshut regional court, are serious. The public prosecutor's office charges the father of three children with bodily harm, attempted serious sexual abuse of children, attempted rape, attempted sexual abuse of those under protection in the majority of cases with rape, sexual abuse of those under protection and sexual intercourse between relatives. In the second incident she was no longer strong enough to defend herself

On the video recording from 2020, she looks delicate and fragile, as if she were the twelve-year-old who had just been yelled at by her father in the family's apartment about why she "has to destroy the family." And who then had to defend herself against rape with all her might.

According to the prosecution, the student was no longer strong enough in a second incident in October 2019. The 41-year-old is said to have undressed his daughter in her room and then carried out “full vaginal intercourse” against her will. The student, who was already receiving mental health treatment at the time, was only able to defend herself to a limited extent due to previous cannabis and medication use.

A teacher jumped into action to help the girl

After the first incident, the girl was taken to the child and adolescent psychiatry in Munich after a teacher took action. Her dad also beat her up so badly that she could no longer sit properly at school, the student reported to the detective. But she only told the teacher and the school's youth social worker about the beating. Her father threatened her that “something bad would happen if I opened my mouth.” And he constantly beat her mother, the girl said - and, after another heavy silence: "I preferred to stay in my room and cut myself."

As the defendant said when his personal details were recorded before the fourth criminal chamber, he is now divorced from the mother of his children. Nothing more was heard from the 41-year-old. There was no information about the allegations. After reading out the indictment, defense attorney Robert Alavi suggested a legal discussion between those involved in the case. This took some time. But as presiding judge Michaela Wawerla reported afterwards, “an understanding of the ideas is utopian”.

The defense attorney believes probation is conceivable

The public prosecutor stated that even if the defendant confessed, they would seek a prison sentence of around six years. Alavi, on the other hand, can certainly imagine a punishment in the “probable range” for his client. Dates are scheduled for the process until June. Several experts will also be heard.
