Highlights: Enrique Buscio was one of the officials who ruled in favor of the scandalous contracting of insurance with the intermediation of brokers allegedly linked to former president Alberto Fernández. He is also the official who, on behalf of the organization, decided in 2021 not to appeal the court ruling that enabled the collection of a double life pension by former vice president Cristina Kirchner. The appointment generated loud noises inside the National Social Security Administration, convulsed in recent days by the wave of layoffs.

It is Enrique Buscio, who was appointed to a key position in the organization. During the brief management of Osvaldo Giordano he had been relegated, but Mariano de los Heros rewarded him.

In the midst of the

controversy over the hundreds of layoffs and the closure of delegations

in different parts of the country, the head of ANSES, Mariano de los Heros, appointed

Enrique Buscio

as head of the organization's strategic Legal and Technical Secretariat , one of the officials who

ruled in favor of the scandalous contracting of insurance

with the intermediation of brokers allegedly linked to former president

Alberto Fernández

, who charged millionaire commissions for their intervention.

Buscio, who has held relevant positions within the ANSeS for years, is also the official who, on behalf of the organization,

decided in 2021 not to appeal the court ruling that enabled the collection of a double life pension by former vice president Cristina Kirchner

, a benefit that currently exceeds $14 million monthly.

Buscio's rise was notable after the arrival of De los Heros as head of the ANSeS executive directorate in February.

From being relegated during the initial administration of Osvaldo Giordano

, who was asked to resign by President Javier Milei after the controversy generated by the negative vote of his wife, deputy Alejandra Reyes, to the Omnibus law, with the arrival of the new director

it went to first occupy the General Directorate of Legal Affairs

of the organization, the same position he held during the mandate of Alberto Fernández, and finally

this Tuesday he was appointed in charge of the Legal and Technical Secretariat

.

The new appointment was made official through resolution 58/2024 of the ANSeS,

published in the Official Gazette with the signature of De los Heros

, which also established that the official should be recognized for the perception of the salary difference between his current role and the new one assigned.

The

appointment generated loud

noises inside the National Social Security Administration, convulsed in recent days by

the wave of layoffs and the announcement of the closure of various UDAI

(Comprehensive Care Unit) of the organization inside, which was Rumors of a step aside from De los Heros have been added in the last few hours.

Sources from the organization questioned the decision to promote Buscio, recalling that during his time in the Legal Affairs department,

the opinions in favor of the controversial hiring of Nación Seguros were validated,

which included the intermediation of brokers close to Alberto Fernández, who would have been paid commissions to ANSES for

more than 20,000 million pesos

.

Buscio's role with insurance

The scandal, reported by

Clarín

based on the results of an audit carried out by Giordano's management, led to

a complaint investigated by federal judge Julián Ercolini

, who ordered more than a hundred raids, while prosecutor Ramiro González charged to the former president for the crimes of violation of the duties of a public official, abuse of authority and embezzlement of public funds. "

Every administrative act must carry a prior opinion from Legal Affairs, which validates the contracting

, bidding or decision adopted," the spokespersons explained in reference to the role of the area in charge of Buscio.

But the questions against the promoted official do not end there. Also as Director of Legal Affairs, he validated in October 2021 that Cristina Kirchner receives a double pension for life, one for having been president and the other for her husband, the late former president Néstor Kirchner. For both benefits, the former vice president currently receives $14,548,836.38 gross per month.

That case was prosecuted after Mauricio Macri's administration resolved that the collection of both benefits was incompatible and annulled the pension as former president.

Cristina complained in court and in December 2020 a first instance ruling ruled in her favor

.

The ruling became final in November 2021 - already during the administration of Alberto Fernández - after the ANSeS, based on an

opinion prepared and signed by Buscio, recommended not to appeal the sentence and allow double collection of benefits

. "It is considered that intervention should be given to the Executive Directorate of this Administration in order to submit for its consideration the withdrawal of the appeal filed in a timely manner," the now promoted official then ruled.
