The checks on the Genoa breakwater and on the "critical issues that emerged" will continue "from 2022, according to the procedures established by law". And in 2023, "the various irregularities found and the indications for improvement" were reported to the commissioner structure. But the contracting authority contested the Authority's competence instead of "resolving the issues raised in time". Thus the Anac responds to the MIT sources by underlining that the Authority "as always does not act to block, not having the faculty or powers to do so, but to facilitate the implementation of the works with due respect for legality".
The Authority led by Giuseppe Busia recalls that, after having indicated the irregularities to the commissioner structure, the contracting authority "decided to concentrate its activity on contesting Anac's competence to intervene and in defending its actions, without making any effort to resolve the highlighted problems in time" .
Therefore, with the resolution of March 20, the observations were "formalized. Once again - underlines the Anac - not with the intention of stopping the work, whose strategic and fundamental character is not questioned but, on the contrary, precisely to prevent this important implementation from being blocked or delayed later, due to failure to comply with legal procedures, also putting Pnrr funding at risk". In fact, the Authority's intent is not to "block" the works, "among other things, not having the faculty or powers", but to "facilitate the implementation with due respect for legality, the rules of transparency and competition, so as to allow intervention to be carried out on time, avoiding those irregularities which may also have an impact on the disbursement of European Union funding".
